Chief Justice Roberts temporarily freezes end of Title 42 immigration policy

Supreme Court Chief Justice John Roberts on Monday put a temporary hold on the termination of a controversial Trump-era immigration policy known as Title 42 that was set to end on December 21, leaving it in place for now.
But in a brief order Roberts signaled that the court wants to act quickly and asked the Biden administration to respond by 5 p.m. ET Tuesday to an emergency appeal filed by a group of Republican-led states.
The brief order from Roberts means the policy that allows officials to swiftly expel migrants at the US border will stay in effect at least until the justices decide the emergency application. The order does not necessarily reflect the final outcome of the case.
The states had raced to the Supreme Court earlier in the day in an emergency bid to keep in place a Trump-era immigration policy that is set to go off the books Wednesday. #Immigration #jessicaschneider #CNN

    1. The Democrats have been trying to improve border security. Biden doubbled the number of border security agents and is trying to get more help at the border. It is legal to come into the country and file for asylum by international law and the constitution. So either way, it is legal. You also have to take into account that some have the luxury of waiting in their own country while others are under threat of death which is why they take the risk of a dangerous journey to get here. There is going to be a huge surge because of all those that have been waiting for title 42 to be lifted. All along children and families with children have been allowed to be processed and given court dates and stay. The GOP has killed several attempts of improving border security . Even their own bills because it makes a good issue to campaign on. The Biden administration is working on getting money and help to the border communities involved. .

  1. This shouldn’t be a political left vs right issue. Borders must be secure, that’s it, no ifs or buts. If you want a country, this must be observed. Matters of immigration are to be handled by the embassies.

      Title 42 was an emergency declaration based on the pandemic.
      Are we still in a health emergency or not?
      If not, it has to be revoked and we go back to enforcing the law as written. It’s simple. Your feelings about “others” has fackall to do with it

    2. The surgeon general is the only one that can decide to invoke title 42. He can also end it. The law puts that in his hands. No one else. Unless Congress repeals the law, then the surgeon general is in charge of title 42 no matter what the Supreme Court says.

  2. All the end of Title 42 means is that they revert back to Title 8 which is what they operated under pre pandemic while Trump was president.

    1. You forget that under Trump we had remain in Mexico. This regime without title 42 has no tool to make people wait abroad while their bogus asylum claims are denied, so its just catch and release aka open borders which is the whole reason they keep coming.

  3. We should be taking care of our own homeless first and they can get in line like everybody else and wait their turn!!!! Us taxpayers who are already struggling should not have this unnecessary additional burden put upon us because it’s the right thing to do and some people’s minds

      Yes, they should be allowed to stay until we determine whether they qualify – how hard is that for you to grasp? Your second point is well… stupid. For sane people like me, the anti-Jewish sentiment that kept so many from being able to seek asylum here is a shameful page in our history – just as this is. BTW, when most were trying to get out, there was no holocaust – but they knew they were likely to be in serious danger if they stayed. We should have let them stay, and found out if they had good reason for their fears, shouldn’t we?

      If your story is true, your family was not treated well by us, and you are rightfully angry about that. Their mistreatment is a big part of why our laws for refugees and asylum seekers were changed – so we will not make the same mistake again.

      Sorry about your selfish, resentful attitude, only a long, honest look in the mirror can help with that. But your assumption that these people have nothing to offer shows your bigotry. My family experienced that in the past. When my great, great grandfather came here, he had no education – he was a sharecropper for some British lord in Ireland. They fled the potato famine. He and his family worked long hours for meager wages that often left them hungry, putting food on America’s tables. His son (my great grandfather) became a decorated Major in the US Army, and his son, my grandfather became a District Attorney in Chicago.

      My father was a career Naval officer, My older brother a career Army officer, and my other brother is now running a tech start up that may (probably will) produce one of the most revolutionary devices ever to save stroke victims. I have done some good too, including 8 years of military service, but they did better than me, I think.

      But all that came from letting in an unschooled man and his family fleeing starvation.

  5. Thank goodness Title 42 will NOT end on Wednesday, December 21! Our borders should be closed and migrants should legally apply for asylum in Mexico.

    1. @CCR That’s a false equivalency. A point of entry we are focused on is an official border crossing. The U.S. is not full! I don’t know where you live, but I live in an immigrant city. Over 100 different languages spoken in a city of 150K. Cultural exchange is what makes America different then most of countries. It is against my religion to turn away anyone in need. I think people are losing their humanity because they don’t have compassion. Its selfish to turn people away or allow children to starve. No one cares about the Northern border. Wonder why?

Canada is a developed country, most people don’t try to illegally immigrate to US from there. It’s nice of you that you are trying to help others, but by supporting people who are skipping the line, where other people are waiting to receive work visa thru the right way thru the embassy in their country to come here legally is not the way to go.     3. @CCR Our system is fundamentally broken and has not been addressed. It’s a contentious issue. The immigration system needs a major overhaul. IMO walls aren’t the answer. People still are coming. Question, If you were in a country like Haiti and you can’t protect or feed your family what would you do?
