Dominion files $1.6 billion defamation lawsuit against Fox News

Dominion Voting Systems, a voting technology company that was the target of baseless conspiracy theories about the 2020 election, filed a $1.6 billion defamation lawsuit against the right-wing channel Fox News..
The company alleged that the network "recklessly disregarded the truth" and participated in a disinformation campaign against it because "the lies were good for Fox's business."
In the immediate aftermath of the 2020 election, then-President Donald Trump falsely asserted that the election had been rigged against him. His allies promoted outlandish conspiracy theories about Dominion to support Trump's false claims.
"Fox took a small flame" of disinformation and "turned it into a forest fire," Dominion said in its lawsuit.
A spokesperson for Fox said the network was "proud" of its 2020 election coverage, describing it as standing "in the highest tradition of American journalism." The spokesperson added that Fox will "vigorously defend against this baseless lawsuit in court."

    1. @Adam Taylor Don,t be so sure. They worship the almighty dollar and if fox becomes an annoyance they,ll dump it. The money will come out of fox assets, not their personal funds. The shareholders will lose money when the share price plummets. By then Murdoch will have gotten his money out in time. That.s how the rich protect themselves.

    2. To prove Fox’s defamation, Dominion must prove:

      1) Fox makes a false statement purporting to be fact;
      2) communication of that statement to a third person;
      3) fault amounting to at least negligence; and
      4) damages, or some harm caused to the Dominion who is the subject of the statement.

    3. @NOW WHAT I didn’t watch Fox, but if Fox said that dominion was part of a conspiracy to steal the election rather than saying that states didn’t prove that dominion didn’t do so, then Dominion might have a decent chance of proving all 4. Saying that someone committed a crime without having evidence to back it up, rather than saying that they should be investigated because they are suspicious, is probably at least recklessness if it is repeated over the course of many months on a news network. Fox might try to pull the defense that they pulled with Carlson that reasonable viewers should have been on alert that Fox was engaging in hyperbole, but considering that the election fiasco has been going on for more than 4 months, the court might say that Fox should have known that there was a significant number of people who actually took them at their word without healthy skepticism and that Fox had a duty to adjust their actions accordingly.

    4. ​@Joon Park What about (4), namely, damages caused to Dominion i..e. economic loss such as loss of earnings, profits or income, loss of contracts, loss of opportunity to earn income in the future, or any other losses of a monetary nature, etc.

    5. @NOW WHAT Take this with a grain of salt since I just cast a brief look over the complaint, but apparently, dominion is seeking $1.6 billion in lost profits and enterprise value, plus more than $1 million in security expenses and expenses combatting disinformation. For 1.6 billion, I would be surprised if they got the full amount since their claims sound pretty speculative, but the court might salvage some part of their claims. I really don’t want to look through their analysis for why they are entitled to 1.6 billion, so I won’t be getting into what parts the court might salvage. For 1 million plus though, they probably do have a case with that as long as they were reasonable about their expenditures.
