  1. Why is no one looking into how the National Archieves are so fast and loose with Classified and Top Secert Documents. They seem to be scattared everywhere. How can that be? Where is the accountablility at the National Archieves? Where is their Code of Ethics as government employees. Seems like gross negligence to me. And Joe, if the N A was doing their job you would not be against the ropes.

    4. @Chris Orrill  I don’t know Trumps excuse. Do you know Biden’s excuse? Neither does Biden. But even left leaning reporters say Trump didn’t have malicious intent. More of he wanted them for a keepsake. Fox has other suggestions as to why he had them. But the point is, at least he knew where his documents were. Biden lost 10 highly classified documents for years.

  2. There needs to be an investigation into the National Archive, seems like there is a trend of them not knowing where sensative documents are.

If Bide or his people were careless, then that needs to come out also. If there is another explanation, then that needs to come out also. No one is above the law.

  4. My Merchant account records for my business are more secure than our country’s classified docs. Apparently, anyone anytime can take classified docs. My merchant account provider audits all my records annually and I have to fill out a form annually on how I accept and keep credit info.

    1. Could it be, and this is just a thought, that the number of documents generated by the United States government, might be slightly more than your Merchant account?
      Something else you may not know the archives collects, catalogs and stores Every scrap of paper, and record of any kind that the White House generates including paper the president just doodled on. And there are only about 3,000 full and part time employees who are responsible for collecting, categorizing, cataloging, distributing, tracking and storing the entirety of the archives and records generated by the United States government!

  5. Libraries never let me forget about checked out or late borrowed books… how does the national archives not know what has been taken out and viewed?!?

    1. It’s likely these documents were never in the NA.. Agencies create documents. The NA creates records of those documents and tracks them. It’s their job to see to it documents are stored correctly and given to the NA at the end of their lifespan. It’s possible the NA did know the documents were missing, but no one knew where they were. They could have been misplaced by a staffer. It’s possible the NA didn’t know because there wasn’t a record for some reason. No one knows at this point.

    2. Point noted but none of this ORIGINATES with the National Archives. They are the depository of the records after the fact, not their origin or distribution point.

  7. Here’s my issue: I have been an original classifying authority or OCA. I have been a classification action officer or CAO. In any instance if either myself or any of my troops held on to sensitive information, we would be under a court martial and put in the brig for a few years to say the least DESPITE intent. Having sensitive materials in your physical possession whether you took them yourself or someone did on your behalf comes with grave consequences unless you’re an elected official evidently. What most people fail to realize is that even in the world of TS/SCI, there are levels of information. One person can have 300 documents and one can have 10 but it’s about what is stored within that matters. Both parties should be held liable via special counsel to determine the severity of what was leaked.

As far as the issue of intent, it is considered an important factor as regarding whether to bring charges or in obtaining a conviction, but it is not definitively a requirement if there are other aspects of accountability that have been neglected. There are cases where negligence (without intent) seem to have considerable bearing, say for example, a school bus driver who comes to work drunk and drives the bus (full of school children) over a cliff, resulting in loss of life and/or serious injury. The bus driver might have not had any intent to drive the bus off the cliff, but his state of intoxication would be likely be regarded as criminal negligence and in cases like this the driver would probably be doing serious time in prison. I am not sure this is entirely fair because the same action (showing up for a job involving the transport of persons but involving an consequences that were minor and did not result in any significant injuries) would certainly be treated more leniently.

      In any case it does seem that simply being found with a top secret document in one’s possession at an unauthorized location can result in prosecution & criminal conviction, but the intent of this aspect of the espionage act is probably to assist with the prosecution of spies, who may be very skillful at concealing their purposes and carefully avoided activity that might reveal their state of mind. But their being a basis for suspecting espionage is connected with the particular circumstances, and there is probably no serious suspicion that Biden is a spy, so that part may not be applicable to him.

      Also, violation of the espionage act depends on whether the document(s) were improperly possessed or stored intentionally, regardless of specific criminal intent, as opposed to entirely by accident. The security consequences of the improper handling of secret documents may also have bearing, i.e., should it be found that there has been a breach impacting national security.

      Finally, unless there is somehow neglect of legally required duty, diligence, or of some similar supervisory requirements, it would be *absurd* to charge a person for a crime if they were not involved in the commission, and did not have any knowledge of the criminal act. Otherwise we’d all be guilty of all crimes. So if Biden played no part in storing the documents, and had no knowledge that they were stored in this office, and further did not somewhere neglect policies that would have prevented any possibility of the documents ending up where they did, there is really nothing that he could be considered legally culpable for…

  8. When you ask something like “why was this not immediately disclosed . . .” when it was “immediately” before the midterm, the question sounds naive, but also raises the question of how it was that these documents were “discovered” at that particularly time.
