  1. But obstruction is impeachable. Trump has blocked every bit of evidence that could paint a clear picture of his entire administration. That is not only obstruction, it is abuse of power. Executive privilege is not allowable when in the defense of criminal accusations. Trump might have gotten away with withholding, but he tried to spin it and cover it up. Those are the crimes he is guilty of.

    1. Correct, a 1974 court ruling was that there is no execuitive privilege in cases where the execuitive branch broke the law. By not notifying Congress of holding the Ukraine aid, and going over the 45 days allowed to hold the fund, Trump broke the law and execuitive privilege doesn’t exist here. You also have court rulings that attorney client privilege doesn’t exist if the lawyer believes his client broke the law, as they also cannot willfully lie in court which would be against their duty as “officers of the court”. Trump and his defenders are pressing every law we have to prevent corruption, the problem is most of these rules were made on a belief in good faith by the defendants lawyers or the President himself. Trump has shown for decades he will lie to benefit himself, so why would he suddenly choose to tell the truth? Also the founders wrote into Federalist papers that seeking foreign interference into our elections was an impeachable offense, and George Washington also said that there is no execuitive privilege in cases of impeachment because people need to know the whole truth. Republicans have decided to turn their backs on the constitution and the founding fathers, they must pay in the next elections for betraying our country and all that it stands for.

    3. @Mainely True enough, but I fear this is a different brand of totalitarianism. It’s a kind of ‘group’ rule… Oligarchy to be exact. It’s being brought about by the greed of the 1%. They’re busy buying influence, taking over State Legislatures and stocking the Courts for the right wing. When the SCOTUS ruled for the Corporation’s ‘Dark Money’ in their Citizens United decision our democracy was grievously wounded. It’s on life support now.
      They are in the process of the dissolution of the State and ignorant disruptors like Trump and his base are making it easy for them by preying on our differences.
      The Right Wing lunatic fringe has taken over but they are not really responsible for their success; the billionaire class put them there and now they have a tiger by the tail. This is deadly serious; deadly for democracy, the western alliance, and for America. The big winner is Putin.

    The Trump administration initially told Congress it was releasing the aid to Ukraine on “February 28.” It repeated that assertion to Congress again on “May 23,” but failed to explain to lawmakers but struggled to explain — both publicly and to the lawmakers who approved the aid — exactly why the funds were withheld.

    Even Senate Majority Leader Mitch McConnell couldn’t get a straight answer from Secretary of State Mike Pompeo and Defense Secretary Mark Esper over the summer on why the aid hadn’t been dispersed yet.

    But then on “September 11,” the Trump administration suddenly disbursed the money.

  6. Changing you legal argument mid trial is grounds for a directed verdict…in a real trial, btw. This is bad lawyering, and in a real court this would get attorneys sanctioned. This is not a real court, and this is not a real trial, however.

    1. I was flummoxed yesterday when Sekulow _brought up_ the Bolton manuscript as part of his own presentation, and then said that it was “inadmissible”. I dare say, once he brought it up, it was not only “admissible”, but part of the evidence!

    1. I believe it’s GAO, but yes, their official report confirmed Trump broke Federal laws by withholding the aide to Ukraine.

    2. The Impoundment Control Act allows 45 days of holding congressional funds, with notice to Congress about holding the funds. Trump didn’t notify anyone, went over the 45 days, and only released the funds after he released the partial transcript of the phone call to Ukraine on July 25th.

  9. OAB the government watchdog said it was illegal to hold the aid for one second let alone until they investigated the bidens. The president is not allowed to withhold the Congressional funds that were given out for any reason
