C H Given that Nixon tried to claim Executive Privilege as reason for not complying with a House subpoena of the Oval Office tapes and the Supreme Court unanimously ruled that Nixon had to comply with the subpoena, I don’t understand how Trump’s failure to comply with the subpoenas of documents and his block of witness testimony isn’t automatic grounds for removal from office given that SCOTYS has already set the president regarding the President being required to comply with a subpoena in an impeachment proceeding? In a regular court case, a defendant would never win an acquittal by not complying with a subpoena of documentary evidence. When the defendant fails to meet the subpoena deadline, the judge throws the defendant in jail until they agree to provide the subpoenaed information. Once someone doesn’t comply with a subpoena in a normal court case, the failure to comply with the subpoena becomes the #1 issue in the case and whatever the defendant is charged with effectively gets put on hold until the defendant complied with the subpoena. But until the defendant is willing to comply with the subpoena, they sit behind bars
In this impeachment trial, Republican Senators are going to allow Trump to be exonerated by not complying with subpoenas of the very evidence that is proof of the crime or wrongdoing. If this is allowed to stand, then impeachment will not be possible for any future president, as all they would have to do is keep the evidence hidden by not complying with a subpoena and this Senate will have made that precedent available as a defense.

The situation is therefore something like having 2,000 KG anvils dropping all around you and what do you do next. Republicans have not even publicly disclosed or acknowledged the fact of involvement of the above named individuals — a bridge yet to come if the impeachment proceedings are allowed to go on. Since the start of the Trumpian mess back a few years ago; we have been trying to figure out what movie we are in. Looks like this one is Polanski’s “Chinatown” — the deeper one goes; the more ugly and horrific it gets; making one wish that they never found out in the first place.
