Are they insurrectionists or protestors? To be insurrectionists, they would have had to, by force, stop or prevent the exercise of lawful orders or powers. There is no proof beyond reasonable doubt that their intentions were other than protest. The congress evacuated out of precaution; but no one threatened any Member of Congress with force. They returned and then resumed business. They were not prevented.
Of course, all criminal violations should be prosecuted to the fullest extent of the law. But insurrection is a bit of a stretch when there is a more likely alternative explanation like protest gone awry. It is far more dangerous to freedom people throwing around accusations of insurrection to suppress protest than it is to protest.
