Are they fishing during breeding season?
Is a moderate livelyhood in the treaties or is that something that they are just adding now?
Not just adding it now it’s always been in our treaty to hunt and fish. Unseeded territory (1752)

From what is being reported that seems to be a recent addition by the Canadian supreme court, and if it is a recent addition than I would have to say that treaties are negotiable.
Is the fishing going on during breeding season?
The definition of “subsistance living” obviously needs to be better defined by DFO. That being said, the commercial fishers have a stake in the process and have to be accounted for so that the industry is sustainable and equitable for all concerned.
