A man who kept a chokehold around the neck of a fellow passenger in the New York City subway, leading to the other rider's death, turned himself in to authorities Friday on a manslaughter charge that could send him to prison for 15 years.

Manhattan prosecutors announced Thursday they would bring the criminal charge against Daniel Penny, 24, a U.S. Marine Corps veteran, in the May 1 death of Jordan Neely, 30.

  1. An incident similar to this unfolded for my friends and me in Honolulu, Hawaii. I was wholly conscious of my actions. I managed to subdue an individual twice my size, placing him in a chokehold as well. The intent behind my chokehold was not lethal; it was merely to immobilize him, allowing my friend and older brother to handle the other individual. The chokehold was forceful enough to keep him grounded but not to endanger his life.

    It’s crucial to remember that when employing a chokehold, you must continuously monitor the person’s status. If the individual under your hold appears lifeless, it’s essential to immediately administer life-saving measures such as CPR.

    I believe in preserving life, not making choices that may jeopardize it.

    1. Thank you for stepping in and subduing someone creating danger to themselves and others. I wonder if the Marine administered any CPR when he noticed the guy no longer struggling.

    2. The guy was scaring people and needed to be restrained for sure!

      But chocking him 15 minutes?
      the guy was warned by a bystander that he was choking too hard for too long and said “you don’t want to catch a murder charge, make sure he’s breathing” 😮

    3. @Rhonda McKnight new footage showed him trying to save his life, he was supposedly still conscious after he got out and died after the fact.

    4. He was career criminal, a VIOLENT career criminal. The people in that car were trapped, and finally someone, instead of filming the danger, stood up and stopped it. This is what more people need to do, make the criminals afraid, make them go back into the shadows.

  2. The real question is where was the family if this guy needed help? Obviously none of them wanted to take him in and get him the help he needed.

    1. I have family. They arent in your pocket everywhere you go. Mental breakdowns happen to everyone at any time.

      He needed to be restrained!
      But he was choked too long, and he died.

    2. ​@Kyla Armstrong-Benjamin How long did it take the cops to get there? That will play a factor in this as well. Had the cops and they arrived sooner to apprehend Neely, this would have been avoided but then again, people are dumb.

  4. jordan neely got what he was looking for, and thats on him. In this climate of fear and anger, think twice before inviting your demise. Also if you as a family loved him so much, why was he not under your care, food, clothing, shelter?? YOU just as much finished him off. But you want justice? for what? Ridiculous to think that every thing is gonna be okay when you act like a nut.

Now the family shows up to speak for the homeless man.When they smell them millions coming they show up, meanwhile he was alive threatening and terrorizing people hungry and homeless needing the help from family they were never there for him.I seen the same that has gone on before where families show after the person has died because they smell that money.

  8. If they are threatening other people it’s time to take action there should’ve just been more people willing to help out to restrain the man or at least have an officer on the train they could hand cuff him.
    It is sad what happens to our mental family members but where was his caretaker that would keep him out of trouble?

  10. His family are the ones that let him go on the streets, but now they think they’re gonna get a check for interviews, GoFundMe money, or wrongful death suit suddenly they are there for him.

  11. This press conference was nothing more than a lead up for them all to get paid. These lawyers don’t even know what they are talking about. It’s easy to say that some mental health facility should have just held Neely because the family requested it. It doesn’t work that way.

    The one lawyer is totally wrong when he made the statement that people shouldn’t be responsible for their own safety. There are several supreme court cases that affirm that the police are not responsible for your individual safety but only for the safety of the population as a whole. This is why you don’t see police departments being successfully sued for someone’s family member being assaulted or killed.

    But the guy choked him too long!
    And he died.
    How do you slowly choke someone for 15 minutes and are then surprised that he died?
    He was warned by a 3rd party, that he could die.
    He said “you don’t want to catch a murder charge!”

    1. @Russell Shaw Shaw If the other riders had the called the cops to get there sooner, Neely would have been apprehended by the authorities and be able to commit crimes another day. Truly a sad tragedy for Neely and his family. May he rest in peace in hell.
