  5. When Dems take the Senate, they need to ram through all the legislation that they can for 2 years then put the filibuster back.

    1. How about they do a good job for the people and thereby keep the senate? Probably won’t occur to many of them.

    2. Then the Republicans will just do the same thing when they get the Senate back. Why not actually give people something for their vote and give the 90 million people who don’t vote a real reason to?

  6. The judiciary will need to be reformed in 2021. That’s just the way it is. But right now the most important thing the people of America need to do is vote. And vote in numbers too big for the GOP to rig. Vote Trump Out.

  7. How unelected people – SCOTUS – can overturn legislation that is supported by the majority of Americans, is unbelievable. If this is American democracy, it stinks!

    1. They are elected….by the Senate, which is a highly unrepresentative institution, which ought to be abolished together with the Presidency.

    2. It is a supreme courts responsibility to interpret the law NOT create or overturn. If legislators want to prevent interpretation then the should be more specific in their creation of law.

      The reason they don’t is because they are cowards and afraid they will be voted out on issues like abortion. So they push it off on the court and then criticize the outcome. It’s irresponsible and hypocritical because they knew what they were doing when the legislation was created.

    1. That’s not what the above quote says. If anything it says that Smith must prove that the utterance affected his life in a substantial way beyond a personal affront. If not, then there can be no damages awarded.
      The utterance could of been said in jest, or sarcastically, or in a song he was singing. Where is the rest of the case that gives the context of how it all came about as required by law to prove such a case?

  10. If she is unwilling recuse herself from any 2020 presidential election case she will appear to be a Trump stooge and the confidence in an already compromised judicial branch will erode.

    1. That is Trump’s plan. It’s called poisoning the well. If she recuse herself Trump probably won’t want her, if she doesn’t prior to being appointed then it looks bad (and rightly so to a degree) which why they recuse themselves so as to not give “an appearance.” But nothing is stopping her once appointed though either. .

    1. Billie Matteo, you’re spot on. Sen Sheldon Whitehouse just did a brilliant presentation on that very subject during the Barrett hearing, which is on YouTube, and Barrett looked very uncomfortable while he spoke, as well she should.
