Dominion files $1.6 billion defamation lawsuit against Fox News

Dominion Voting Systems, a voting technology company that was the target of baseless conspiracy theories about the 2020 election, filed a $1.6 billion defamation lawsuit against the right-wing channel Fox News..
The company alleged that the network "recklessly disregarded the truth" and participated in a disinformation campaign against it because "the lies were good for Fox's business."
In the immediate aftermath of the 2020 election, then-President Donald Trump falsely asserted that the election had been rigged against him. His allies promoted outlandish conspiracy theories about Dominion to support Trump's false claims.
"Fox took a small flame" of disinformation and "turned it into a forest fire," Dominion said in its lawsuit.
A spokesperson for Fox said the network was "proud" of its 2020 election coverage, describing it as standing "in the highest tradition of American journalism." The spokesperson added that Fox will "vigorously defend against this baseless lawsuit in court."

    1. @user name it’s for all voters regardless who you voted for. It’s not a left or right suit. It’s a civil right suit.

    2. @Drought Tolerant, uh huh, yep, like was just said, i love it when lawyers rip off right wing loonies.

  1. Fox’s legal department should have known this would happen. Were they asleep while Fox was airing their conspiracy theories?

    1. @Adam Taylor Don,t be so sure. They worship the almighty dollar and if fox becomes an annoyance they,ll dump it. The money will come out of fox assets, not their personal funds. The shareholders will lose money when the share price plummets. By then Murdoch will have gotten his money out in time. That.s how the rich protect themselves.

    2. To prove Fox’s defamation, Dominion must prove:

      1) Fox makes a false statement purporting to be fact;
      2) communication of that statement to a third person;
      3) fault amounting to at least negligence; and
      4) damages, or some harm caused to the Dominion who is the subject of the statement.

Tick some of or all of the above 4

    3. @NOW WHAT I didn’t watch Fox, but if Fox said that dominion was part of a conspiracy to steal the election rather than saying that states didn’t prove that dominion didn’t do so, then Dominion might have a decent chance of proving all 4. Saying that someone committed a crime without having evidence to back it up, rather than saying that they should be investigated because they are suspicious, is probably at least recklessness if it is repeated over the course of many months on a news network. Fox might try to pull the defense that they pulled with Carlson that reasonable viewers should have been on alert that Fox was engaging in hyperbole, but considering that the election fiasco has been going on for more than 4 months, the court might say that Fox should have known that there was a significant number of people who actually took them at their word without healthy skepticism and that Fox had a duty to adjust their actions accordingly.

    4. @Joon Park What about (4), namely, damages caused to Dominion i..e. economic loss such as loss of earnings, profits or income, loss of contracts, loss of opportunity to earn income in the future, or any other losses of a monetary nature, etc.

    5. @NOW WHAT Take this with a grain of salt since I just cast a brief look over the complaint, but apparently, dominion is seeking $1.6 billion in lost profits and enterprise value, plus more than $1 million in security expenses and expenses combatting disinformation. For 1.6 billion, I would be surprised if they got the full amount since their claims sound pretty speculative, but the court might salvage some part of their claims. I really don’t want to look through their analysis for why they are entitled to 1.6 billion, so I won’t be getting into what parts the court might salvage. For 1 million plus though, they probably do have a case with that as long as they were reasonable about their expenditures. They might win with punitive damages if the courts think that Fox should cut down on its hyperboles a little, but that’s typically 1-3x amount of the damages awarded so.

  2. “The only thing necessary for the triumph of evil is for good men to do nothing.” Edmund Burke
Good for Dominion going after Fox News and hit them where it hurts! Their $$$$$$

    1. If the corrupt court system wouldn’t view the evidence.. dominion are now opening the door for said evidence to be seen 😉

Colorado case number 1:20 CV-03747 filed dec 2020

    3. Was there any voter fraud. What about ballots found inin the garbage dumpsters it cannot be established that there was no voter fraud

  3. As predicted, their main defense is “We’re not a news channel. We’re an entertainment channel!”
That’s not what your viewers think. Even though the rest of us have tried to tell them that for DECADES.

    1. @Chris Miller My favorite line now is whenever a Democrat or liberal gives me krapp I thank them and ask them to think their kids and grand kids for all of the money the government just gave me because their kids and grandkids are going to be paying it off for the rest of their lives so I thank them and I think Biden is great keep giving us more “free” money … Now we owe the Chinese another 1.9 trillion

    2. @G S To add, Trump was and still is his own problem. The man was not qualified to be President of the United States and after four years he still unqualified. That’s why he was voted out., The democrats nor the media did not force him to tell falsehood after falsehood to the public. For instance 1) No one forced him to attempt to shake down the President of the Ukraine, 2)lie about COVID, 3)suggest outrageous cures for COVID, 4)assert the nuclear threat from North Korea was over, 5)make the good people on both sides comment, 6)say that he will only accept the results of the election if he wins, i7)gnore the fact that Russia put bounties on our servicemen heads and attacked our most important institutions, 8)to lie about the election and hold the outlandish and ridiculous Jan. 6 stop the steal event, 9)tell the proud boys to “stand back and stand by, 10)forward of a video with supporter shouting white power to 80M people, 11) call the mothers of NFL players the B word, and on and on a nd on and on. He is under investigation criminally and civily. Left office with a 34% approval rating. Lowest ever.

    3. @Nathaniel Stenzel i do to. It’s on the brink with alexey, and I hope Russia free’s itself from the shackles of autocracy. Even though we probably heading in that direction with Republicans suppression methods.

  4. My neighbor still doesn’t think trump lost. Still flying a stupid trump 2020 flag on his garage.

    1. A crowd funded action against Fox might be a catalyst in bringing change to their being the “opposition” to all Democrat initiatives. Clipping Lachlan Murdoch’s wings before he can learn how low he can go before being absolutely complicit in what happens if violent tensions continue to ascend? Australians can’t comprehend as to why the Murdoch’s hate the US so since they’re enriched themselves over there at America’s expense It has to be profits before principles, right?

    1. @Telegraph Telegraphovich lmao…. Your CNN programming is showing by the simple fact that you made this a Trump issue!

    2. @Connie Dage A trumper going on about others being suckers. Priceless. My shoe size is bigger than your IQ.0

    3. Connie, honey? Why do you think Fox News is being sued?? It’s because they told lies Trump wanted them to tell. Trump IS the issue here. HIS lies ARE the issue here. Let that sink in.

  5. Before he closes his eyes and meet his Maker, Giuliani is going to regret the moment Donald J. Trump came into his life. And I hope Dominion wins that lawsuit and takes FOX News off the air.

  6. It’s gonna be SOOOO satisfying watching hannity, Carlson, pirro, etc walking back their bullshit, which they will have to do to keep their jobs – Fox ain’t gonna pay for lawsuits they will almost certainly lose!

Alternatively they could simply say that no reasonable person would take them seriously!

    1. Don’t forget Laura Ingram they all need to lose their faux position
Fake news & very nasty bully people

  7. They only care about their pay checks. So they just go along with the lies and promote them.
Shut them down and start over

    1. Or don’t start over. Democracy and broadcast journalism will be better for it. The house of cards finally falling.

  8. It’s just entertainment not news😂 tucker Carlson presenting his show with a clown nose and wig

  9. Yes, yes they did!!!!
    You go Dominion!!!!
Now, take a deep breath and add that ‘Citrus Caligula’!!!!
He is worth $10 Billion, sue him for $5 Billion!!!!
He is still spreading his bile!!!!

  10. Easy solution for Fox: Simply use the standard Right Wing defense: “No reasonable person would believe what we claim is ‘news.'”

    1. @Redskin Ridah Biden should sue FOX for the, with holding of funds from Ukraine until they fire the prosecutor that was investigating Hunter lie.

    1. I have to agree. Every company, organization and individual they lie about constantly need to turn around and start suing them out of existence.

    2. and while they’re on it, take SKY News as well !!! They don’t represent Australia’s point of you I can tell you!

    1. That’s exactly what they say… they will use the “reasonable person would believe them” defense😂

  12. They should also be sued by the family members of those who died as a result of their COVID-19 lies!

  13. “Lock them all up”, shouted the Donald when he was the so-called president. So, lock them all up, and the former president too.
