Why the Supreme Court ruled to save Obamacare

The Supreme Court dismissed a challenge to the Affordable Care Act on in a decision that will leave the law intact and save health care coverage for millions of Americans. The justices turned away a challenge from Republican-led states and the former Trump administration, which urged the justices to block the entire law.
The justices said that the challengers of the 2010 law did not have the legal right to bring the case.
Justice Stephen Breyer penned the decision that was 7-2. Justices Samuel Alito and Neil Gorsuch dissented.
The court's ruling comes as President Joe Biden — a firm supporter of the law that was passed while he served as President Barack Obama's vice president — has expressed strong support for the law.
The justices noted that there is no harm to opponents from the provisions that they are challenging because Congress has reduced the penalty for failing to buy health insurance to zero.
"For these reasons, we conclude that the plaintiffs in this suit failed to show a concrete, particularized injury fairly traceable to the defendants' conduct in enforcing the specific statutory provision they attack as unconstitutional," Breyer wrote. "They have failed to show that they have standing to attack as unconstitutional the Act's minimum essential coverage provision."

    1. @Thomas Clark Sorry I’m not understanding how Obama care affects this. Let’s take the example of one insurance company which calculates the premium based on statistics of people getting sick of various disease and the health care cost of hospitals. Statistics probably don’t change but hospitals bills do. So let’s say following your logic that un-insured folks use health care services without paying and the cost went up. That made the insurance company increase the premium. But if these folks are using obamacare as an insurance wouldn’t the number of un-insured at the hospital be lower? I don’t follow your logic

    4. @Cristian Armaselu The Hospital costs are another topic. We could get into that. Have you ever seen Hospital Costs lowered because of the use of Obamacare ? Have you ever seen the costs of Insurance premiums of the people not on Obamacare lowered ? Someone always pays for it. Im a prime example. Not long after Obamacare was signed. My insurance premiums I’d been paying for years went up 400%. My deductibles increased & my coverage decreased. No longer was Dental & Vision a part of my insurance coverage. It was seperated and charged individually on a voluntary basis. I could get it if I wanted to pay a seperate fee for each. These raises were made to pay for the people recieving Obamacare through the New ACA Law forcing insurances companies to cover them.

The only way to truly fix this is to regulate the profits, eliminate the huge bonuses and stock dividends like every other major country that actually cares about it’s citizens more than becoming millionaires via insider trading.

    1. Please understand that the ACA is better than nothing. But there are millions like me still with no access to healthcare, & it’s not free like most countries. I have had to travel to 3rd world countries like Ecuador to be able to afford healthcare for years. Here’s one instance. I paid $250/mo as a young healthy woman, it was supposed to be good insurance. I had pain in my leg & many were concerned I had a blood clot. I went to my doctor, she referred me to get an ultrasound (same as for pregnancy). I waited 8hrs, had to be on phone w insurance much of it. It was 5-10min with a nurse only- she did the ultrasound & found nothing. Offered nothing to look further into what could be causing my pain, no suggestion for what to do about it. I went home & got a $1600 bill that supposedly was AFTER my insurance. $1600 for 5 min to look at my leg. THEN… 1 whole year later I got ANOTHER BILL FOR $1600!! I ignored it thinking it was a mistake. Apparently the doctor I NEVER SAW decided to ALSO charge me. Wtf?? In Ecuador I walk into a clinic & ask them to ultrasound my leg. Maybe it costs me $50. It’s soooooo corrupt here. Obama tried to help a little but there was no way GOP was going to let him really fix it. We get sicker & sicker, insurance companies keep raising their profits by billions.
