Why the Supreme Court ruled to save Obamacare

The Supreme Court dismissed a challenge to the Affordable Care Act on in a decision that will leave the law intact and save health care coverage for millions of Americans. The justices turned away a challenge from Republican-led states and the former Trump administration, which urged the justices to block the entire law.
The justices said that the challengers of the 2010 law did not have the legal right to bring the case.
Justice Stephen Breyer penned the decision that was 7-2. Justices Samuel Alito and Neil Gorsuch dissented.
The court's ruling comes as President Joe Biden — a firm supporter of the law that was passed while he served as President Barack Obama's vice president — has expressed strong support for the law.
The justices noted that there is no harm to opponents from the provisions that they are challenging because Congress has reduced the penalty for failing to buy health insurance to zero.
"For these reasons, we conclude that the plaintiffs in this suit failed to show a concrete, particularized injury fairly traceable to the defendants' conduct in enforcing the specific statutory provision they attack as unconstitutional," Breyer wrote. "They have failed to show that they have standing to attack as unconstitutional the Act's minimum essential coverage provision."

  1. I know the answer: They don’t want their GOP constituents and supporters to have no more health care. All of them GOP are on Obamacare.

    1. @Thomas Clark Sorry I’m not understanding how Obama care affects this. Let’s take the example of one insurance company which calculates the premium based on statistics of people getting sick of various disease and the health care cost of hospitals. Statistics probably don’t change but hospitals bills do. So let’s say following your logic that un-insured folks use health care services without paying and the cost went up. That made the insurance company increase the premium. But if these folks are using obamacare as an insurance wouldn’t the number of un-insured at the hospital be lower? I don’t follow your logic

    2. @steve jette Neither is the party of the working class. Youre living in a delusional fantasy if you think they are.

    3. @Cristian Armaselu Now youre just Trolling. Ive explained it numerous times now. Once more is to much. Its not hard to understand.

    4. @Cristian Armaselu The Hospital costs are another topic. We could get into that. Have you ever seen Hospital Costs lowered because of the use of Obamacare ? Have you ever seen the costs of Insurance premiums of the people not on Obamacare lowered ? Someone always pays for it. Im a prime example. Not long after Obamacare was signed. My insurance premiums I’d been paying for years went up 400%. My deductibles increased & my coverage decreased. No longer was Dental & Vision a part of my insurance coverage. It was seperated and charged individually on a voluntary basis. I could get it if I wanted to pay a seperate fee for each. These raises were made to pay for the people recieving Obamacare through the New ACA Law forcing insurances companies to cover them.

  2. The Party of No can’t understand NO for the 3rd time! Pretty sure they will still attempt to strike Obamacare down. I guess, they will only understand when Mitch says NO for everything the Dems put to the table.

  3. Imagine being so pressed that you’re losing members from your party that you try your best to bring down policies from your opposing party that are actually benefitting people from both sides

    1. @Thomas Clark if you are an American worker why do you need O. care? Get a job with health care. You do know that the cost of a.c.a. is base on how much you makke and how much you have? You either did not do your research before you joined the plan you picked.

    2. @camwyn256 He probably lives in old trailer some where and still has a stack of Bush cans in his yard along with chickens and a bunch of other junk.

  4. I’m surprised by 2 of the justice’s, Gorsuch and Barrett. I would not have thought those two would be on the sides they were.

    1. I her I did and I told my husband that it’s call faking until you make it. And I’m black wasn’t scared at all . And I got my hundred dollars bet from him KMSL never never underestimate an real mother with even children she has adopted that’s an different minority. That’s my girl. Poor trumpy. Lol.

  5. The GOP has been preaching “repeal and replace” for 11 years and they still can’t get it done

    1. Let you idiots live with what Democrats pushed through with zero Republican support. I hope you’re happy that insurance companies are getting rich while people are getting less and less coverage.

    2. @B K
Only reason ACA has any issues is because of GQP trying to dismantle it. You’re complaining about the problem YOU created:/

    3. @jeck jeck Explain exactly how we tried to dismantle it? And since you said “tried” does that mean it’s working exactly as planned? Because it is. We’re getting higher rates, while insurance companies are making record profits. That’s who you’re siding with, chump.

    4. Because there is no replace. their replace is back to your on your own. Health insurance and pharma stock making huge profits is far better than people having health care. The only way to truly fix this is to regulate the profits, eliminate the huge bonuses and stock dividends like every other major country that actually cares about it’s citizens more than becoming millionaires via insider trading.

    5. @B K
Regulatory action to destabilize the ACA by trump for one:/ Ironic, from a party that is against rules, laws and regulations.

  6. Supreme Court needs to refuse anymore cases re: Obamacare. Republicans, the evil empire, trying to take away health care. Let that sink in folks

    1. @Identity Unknown So now you’re changing your story all of a sudden? LOL. Great projection there bud.

    2. @Identity Unknown Where did I ever say I worship Trump? I don’t worship a cult that attacks a country all because they lost.

    3. @Identity Unknown So now it’s antifa again? First you clowns claim the attack was antifa, then was just all tourism, so which was jt?

    1. @theuglykwan How many more times do you think the Trumplicans can lose? The American people are the beneficiaries of this decision. Let them sulk.

  7. I see Amy Comey Barrett was in the majority vote to save OC wonder what Trump is thinking of his Star Justice Player now…

  8. Wait the last guy who was given a seat to the Supreme Court and who was also nominated by Trump was for the “Obamacare?”

    1. @colonel 100 Actually, the only party that needs to be replaced is the ReTrumplican cultist party. Regular Republicans, the ones with backbones, are few and far between.

    1. Legit in Causing harm.. doctors who actually have a education don’t even take care of people who have medicade and Medicare.. it actually kills people disabiles people.. uses the EHR system to cover up malpractice labeled ppl inappropriately so they never get help..should have done med4all..

    2. @Holly Stuart: Lol?¿

While I agree that Medicare For All may actually be better, such as for our society as a whole, you seem, at least, unwilling to recognize the reality there just is not the political will to enact Medicare For All legislation, to be brought to a discussion, amongst either portion of Congress, and a vote…let alone actually get it passed and made ‘the law of the land’. On top of all that, you’re lying about the Patient Protection and Affordability Care Act’, about what it does, why & how it does it.

You’re fear mongering and spinning a `cOnSpIrAcY tHeOrY` in an attempt to justify what you prefer.

      Sad. Pathetic FAIL. Dingleberry.

    3. @Duy Vo: When your profile is finally deleted, rest assured; fore it will inevitably have had something to do with me!

      Thanx for the spam. Moron.

  9. Once again, the Supreme Court have Spoken, Obamacare is Alive and well for the American People, Bravo!!

  10. From : I’m so happy for Americans- everyone should be entitled to healthcare. Can someone get Trump a bucket of Diet Coke – he desperately needs it ..

    1. Please understand that the ACA is better than nothing. But there are millions like me still with no access to healthcare, & it’s not free like most countries. I have had to travel to 3rd world countries like Ecuador to be able to afford healthcare for years. Here’s one instance. I paid $250/mo as a young healthy woman, it was supposed to be good insurance. I had pain in my leg & many were concerned I had a blood clot. I went to my doctor, she referred me to get an ultrasound (same as for pregnancy). I waited 8hrs, had to be on phone w insurance much of it. It was 5-10min with a nurse only- she did the ultrasound & found nothing. Offered nothing to look further into what could be causing my pain, no suggestion for what to do about it. I went home & got a $1600 bill that supposedly was AFTER my insurance. $1600 for 5 min to look at my leg. THEN… 1 whole year later I got ANOTHER BILL FOR $1600!! I ignored it thinking it was a mistake. Apparently the doctor I NEVER SAW decided to ALSO charge me. Wtf?? In Ecuador I walk into a clinic & ask them to ultrasound my leg. Maybe it costs me $50. It’s soooooo corrupt here. Obama tried to help a little but there was no way GOP was going to let him really fix it. We get sicker & sicker, insurance companies keep raising their profits by billions.

    2. @lulu in hollywood No, the ACA is not better than nothing. The insurance companies that you people say you hate, love it for a reason, dummy.

  11. Republicans did this to themselves when they stripped the mandate. Now the court is saying it lacks merits because they already removed the mandate and no one is forced to buy it.

  12. I’m grateful to our supreme court for helping all the American people especially in these hard times thank you

  13. So after so many years with people benefiting from the law, Republicans still want to take insurance away from those who need it.
